Consent to the processing of personal data

The HOREC system, which is used by Hornonitrianske bane Prievidza a.s., abbreviated as HBP – the operation of the Wellness Hotel Repiská***, includes tools that will help users apply the principles according to Regulation of the European Parliament and Council (EU) no. 2016/679 of April 27, 2016 on the protection of natural persons in the processing of personal data and on the free movement of such data, and Directive of the European Parliament and the Council (EU) no. 2016/680. The principles listed below create a new modernized legal framework for the protection of personal data, which aims to ensure respect for fundamental rights and freedoms, especially the right to the protection of personal data in the environment of new and increasingly used information and communication technologies, and at the same time to support the strengthening and convergence of the economies of the member states of the European Union of the Union within the internal market of the European Union. As part of the general protection of personal data of the regulatory base of the Slovak Republic, the Directive will apply:
1. for the processing of personal data within the framework of activities that are subject to the law of the European Union, both the regulation and the law, with the exception of parts 1 to 3 of the law.
2. for the processing of personal data as part of activities that are not subject to the law of the European Union as a whole,
3. for the processing of personal data for the purposes of the execution of criminal proceedings by the competent authority, with the exception of selected provisions of Part 3 of the draft law

Basic principles that are the subject of the GDPR solution:

1. Principle of legality §6 – check whether the fundamental rights of the data subject are not violated during processing. Legal reasons for processing personal data:

a) Records of accommodated guests (§24, point 1, Act No. 253/1998 Coll. of as amended), i.e. House book, the retention period is not determined

b) Reporting to the foreigner police (Act No. 404/2011), supplements the house book, the retention period is five years

  • Travel document number

c) Act 582/2004 Coll. about local taxes and the local fee for municipal waste, is always dealt with by the municipality within its VZN

d) Act on VAT no. 222/2004 Coll. as amended, § 74 letter b, the retention period is until the end of the calendar year in which ten years have passed since the end of the year to which they relate, the data specified in the law “the name and surname of the recipient of the goods or services or the name of the recipient of the goods or services, the address of his registered office, place of business, place of business, residence or address of the place where he usually stays, and his tax identification number under which the goods were supplied to him or the service was supplied to him”

2. Purpose limitation principle §7 – verify whether personal data is collected for an explicitly stated and authorized purpose (collect only data that is defined in the laws applicable to the accommodation facility).

3. Principle of minimization of personal data §8 – check whether the processed personal data is adequate, relevant and limited to the necessary scope.

4. Principle of correctness §9 – processed data must be correct and updated as necessary

5. The principle of minimization of storage §10 – have a specified period for the storage of personal data, taking into account the purpose of their processing

6. Principle of integrity and confidentiality §11 – assess whether adequate security of personal data is guaranteed, including protection against unauthorized processing of personal data.

7. Principle of responsibility §12 – the operator is responsible for observing the basic principles of personal data processing, for the compliance of personal data processing with the principles of personal data processing
data and is obliged to prove this compliance with the principles of personal data processing at the request of the office.
